Know Your Rights! All workers in New Jersey are protected under state law — no matter what your immigration status is.
Under the New Jersey Temp Workers’ Bill of Rights, you are entitled to the following:
- The full minimum wage, plus overtime pay (1.5x) if you work more than 40 hours in a week. In 2026, the minimum wage is $15.92 per hour for most workers.
- Assignment info in a language you can understand.
- Equal pay as direct hires doing the same or similar work.
- Partial pay if your assignment is canceled or moved.
- No agency-imposed fees for transportation or check cashing.
- No threats by your employer to call ICE or other retaliation for asserting your rights.
Regardless of immigration status, workers are entitled to minimum wage, overtime, misclassification protection, prevailing wage for public works, earned sick leave, protection against discrimination and protection from retaliation under New Jersey law.
Employers cannot disclose or threaten to disclose immigration status to hide that they broke these laws.

Protections Against Human Trafficking
Human trafficking occurs when someone uses force, fraud, or threats to control another person — making them work against their will, without pay, or exploiting them sexually.
Examples of human trafficking:
- Withholding wages unless a worker performs sexual acts or extra unpaid work
- Threatening to report a worker to ICE unless they perform sexual acts or work without pay
- Using violence or threats of violence to force someone into sexual acts or labor
